Will I Save Money if I Stay in Jail?

Just because a judge approves and sets your bail doesn’t mean you have to leave jail. If you prefer, you can await your schedule court hearing in detainment rather than posting your bail. Why stay in jail? Some people forgo spending the money on a bail bond, either because they do not want to waste money or they simply cannot afford to temporarily put up the full bond amount in cash. Even if you can afford to pay for a bail bond or front the full bond amount, you may not want to for the simple reason of conservative spending.

Continue reading to learn the average cost of bail, and how much you stand to save by opting to stay in jail.

Average Cost of a Bail

Most states have bail schedules with predetermined bond amounts for certain categories of crimes. For instance, shoplifting might come with an automatic bail schedule of $1000, while domestic violence might have a $10,000 bond or more. The more serious the crime, the higher the bond amount set by the judge. If a charge is a violent one, such as assault, battery, domestic disturbances, and child abuse, you can guarantee that the bond will be set high. Furthermore, all preset bond amounts, however, can be increased upon the judge’s discretion depending on the previously discussed factors. But not to worry, our U.S. Constitution protects us from excessive bond amounts. So they will be fair.

Bail Bond Fees

A bail bond company will charge a nonrefundable fee that is a set percentage of a defendant’s total bond amount. For felony charges, bond amounts will be higher, which means the cost of a bail bond will be too. The premium a bail bondsman is allowed to charge is controlled and regulated by the State’s Insurance Department. Currently, this rates are set between 10 and 15 percent. This means that the total allowable premium that bail bond companies are allowed to charge can be anywhere between these percentages. They get to choose how much they charge within this range. If a person is facing a felony charge and they have a history for fleeing, a bail bondsman will charge on the higher end, closer to the 15% marker. For first time or minor offenses, most stick with the 10% charge.

Saving Money

In order to decide how much you save by staying in jail until your court date, you must also consider what you lose by staying in jail. Although you can save money by forgoing the non-refundable fee of a bail bond, you may subject yourself to lost wages as a result of time off work. Many people have other responsibilities that make the bail bond fee worth paying, such as children and child care, illness, scheduled trips or events, and more. This means a bail bond fee is sometimes more affordable than the other losses you risk by staying in jail.

Personal Information You Must Provide as a Bail Bond Applicant

Whether you are managing your own bail, or posting for someone else, you will have to sign a bail bond agreement. A bail bond agreement is a standard legal contract that holds you liable for the remainder of the bond amount in the occurrence that the defendant (you or your loved one) does not appear for court. Along with signing a bail bond contract and paying a non-refundable fee, you will be required to provide a certain degree of personal information to the bail bond agent in exchange for their services.

Indiana Bail Bonds

Indiana Bail Bonds 317-876-9600

Bail bondsmen charge a non-refundable fee that is a small percentage of the total bond amount, while covering the rest of the bond amount out of their own pockets. They forfeit this money if they cannot guarantee your appearance in court. So when you consider the position of a bail bondsman, you can understand why it is important for them to gather as much information about the person as they possibly can. This information is simply added security that helps ensure the defendant’s presence in court.

Here is some common information that you will be required to disclose to a bail bond company in exchange for their services:

Full Name

If you are posting for someone else, you will have to provide the full names of the defendant and yourself. If you are posting your own bail, expect to provide your full legal name, including your first name, middle name, last name, and any suffixes. Any slang, nicknames, and street names will not be accepted.

Contact Information

You will be required to give all of your contact information to the bail bondsman, including a current phone number, home address, email address, and the phone number to the place of your employment. They may also ask if you are on social media platforms and contact information of close family, roommates, and friends.

Physical Description

A bail bondsmen may or may not decide to take down a physical description. It depends on many factors, primarily personal preference, but also for high-risk cases or flight risks. Included in a physical description may be the description of your primary vehicle too. They may take pictures or just jot down what it all looks like.

Employment Information

You can expect to provide all information for your job. This includes the address, phone number, contact information for your supervisors, and more. You will also have to provide proof of employment, either with recent paycheck stubs or whatever else the bail bondsmen requests. They may also want a copy of your work schedule.

Birth Records

You will also be required to provide your legal date of birth, and the place you were born. This includes the day of your birth, the city or town of your birth, and the state of your birth. A bail bond agent may need this information in the case that they must look up your governmental records, such as court and arrest records.

Legal Documents

Of course, you will need to provide legal documentation as proof of all the information listed above. Accepted legal documents include social security cards or numbers, birth certificates, drivers’ license, state identification card, passport, recent piece of mail as proof of address, and more. Of these documents, you can expect to be required to provide your social security number, a recent piece of mail or official contract that proves your address, and a valid drivers’ license or state identification card.

References

You may also be required to provide more than one reference as proof that you are a qualified bail bond applicant. References will have to be provided in the form of phone number and address, and can be teachers, bosses, co-workers, colleagues, or even family members.

Illegal Alien Numbers

If you are posting bail for an immigrant or illegal alien, you will need to provide the I.N.S. A#, which helps identify them on a federal level, such as immigration court cases and status checks.

A bail bond is a written promise signed by a defendant, or by an indemnitor, which is a person who acts on behalf of the defendant, to pay a fee set by the court in the case that a defendant should fail to appear for their scheduled court hearing after being released from jail. This may sound a bit confusing to those new to the bail bond industry, so review the bail bond process below for a detailed understanding of how it works. If you are still unsure about the bail bonds process, contact our professionals at Woods Bail Bonds for sincere support and advice.

Where the Bail Bond Process Begins

Once you know you require the services of an Indianapolis bail bondsman, contact your agency of choice in the county where the charges originated. Do this immediately following an arrest, or as soon as you are ready to prearrange your release from jail for an outstanding arrest warrant. You may choose to contact the bail bond company and request their services on your own, or you may delegate the duty to your lawyer instead. In jail, detainees are allowed to make as many phone calls as they need to obtain a bail bond, however, bad behavior can have this privilege revoked. From jail you can contact your lawyer, or a loved one to do so for you; or you can simply contact a bail bondsman directly.

STEP

A bail bondsman will require a list of information to begin the bonding process. This includes name, address, phone number, email, date of birth, where the defendant is being detained, the charges they are being held for, the amount of time they have been held thus far, criminal history, employment history, and more. All of this background information is mandatory to obtain a bail bond.

STEP

Once the services are agreed upon and paid for, the defendant themselves, or the indemnitor (person signing for the bail bond), will be asked to sign and date a series of legally-binding documents, called a bail bond contract. This includes a bail bond application form, a bail indemnity agreement, and a receipt of purchase.

STEP

After the bail bond contract is signed, the agent can begin “posting” the defendant’s bond at the jail they are being held at. This can take anywhere from 1 hour, to 48 hours or more, depending on the criminal charges. Intoxicated detainees must wait at least 8 hours before the bonding process can begin at all. But once a defendant is processed in the jail, it should only take a bail bondsman a couple of hours to get them released.

STEP

For those bailing themselves out of jail, the bail bondsman will file for their release from jail, pick them up from the entrance, and take them back to the bail bond office. At Woods Bail Bonds, jail pickup and drop off services are free! At the office, there will be a remainder of paperwork that needs signed and dated, but then the client is free to go home, but under the obligation to appear for all scheduled court hearings. If they fail to appear for even one court date, they forfeit their bond, legally-bound to pay their entire bond amount, and issued a warrant for their arrest.

You Can Get 8% Bail Bonds Right Now!

Indianapolis Bail Bonds 317-876-9600

Indianapolis Bail Bonds 317-876-9600

If your bond is set at $2,500 you can pay the entire amount in cash, which will then be returned to you once you have completed all of your court dates and sentencing; or you can pay Woods Bail Bonds a non-refundable fee set at 8% of your bond amount! At $2500, your bail bond will only cost $200. Now that’s worth not having to deplete your bank account! We also offer prearranged bail bond services for those needing to surrender to an arrest warrant. Do Bail Bonds Help People Prepare for Court?

Yes! There are various ways bail bonds help people in between an arrest and a court date. Having the chance to leave jail and await a court hearing from the comfort of their own home can increase the chances of a person improving their legal situation. Continue reading to learn how bail bonds can help increase the chances of improving a person’s legal situation, and how this can ultimately help people face their mistakes and make better life choices altogether.

Indianapolis Bail Bonds 317-876-9600

Indianapolis Bail Bonds 317-876-9600

The Various Advantages of Bail Bonds

When a person is arrested, they are taken to jail to await their court hearing. Depending on the amount of traffic in the jail, and the type of crime the person was arrested for, court dates can be scheduled days, weeks, or months away from the date of arrest. If a person cannot gain a release from jail before their court date is scheduled, they are forced to stay incarcerated until their court date. If this is the case, a person has no choice but to either make arrangements for their legal situation alone inside jail, or use the court appointed legal counselor for representation in court. Neither scenarios are desirable for a person arrested for a criminal offense. The nest gift of bail bonds is time and comfort.

Time and Personal Comfort

When a person uses a bail bond to get out of jail, they are released back into the world they know and are comfortable with. Whether this is their families, homes, jobs, friends, or something else, it places defendants back into their personal support systems, which leads to optimism and encouragement to make a positive change. Not only does a bail bond give a person a release from jail and lets them get back to their own life, it gives a person time to prepare for court. This includes getting proper legal counsel and hiring a reputable lawyer that is proficient in your particular case and arrest, while also deciding what plans and actions they will take to help alleviate and reduce court sentences and consequences.

On top of these advantages, bail bonds also allow defendants to have time to think about their poor choices or mistakes that caused them to wind up in legal trouble, and to take actions to make a plan toward positive change. This may include clinics and rehabilitation, as well as counseling, therapy, and more. Bail bonds can give defendants a comfortable window of time to reconsider life choices, groups of friends, employment, goals, and more, all of which can help to improve their quality of life as a whole. This all looks good to the courts when it comes time for trial.

You SHOULD NOT Bail Someone Out of Jail if…

Indianapolis Bail Bonds 317-876-9600

Indianapolis Bail Bonds 317-876-9600

Bail bonds are a very common, convenient, and efficient system for those arrested and detained in local jails. Often times when a person is arrested, they call a friend or loved one from jail in order to arrange a bail bond. The person they call will then arrange bail bond services to get them released from jail. This involves having the friend or loved one cosign for and post the defendants bond.

Since this is a sensitive and serious legal matter that involves money and trust, it is important to make a responsible decision if you are the one being asked to bail a person out of jail using a bail bond. Continue reading to learn three specific instances in which you should never bail a person from jail and why.

They Haven’t Called You in a Long Time

When you lose touch with a friend or family member, and you haven’t spoken in a few weeks or longer, it is not a good idea to post their bond if they call you out of the blue from jail. If you haven’t spoken to that person in a while, and the first time you hear from them is when they need you to cosign for a bail bond, it is not a positive situation. The first call after weeks of not talking should be to have lunch or catch up, not to pay for them to get out if jail. This could be an indication that they have burnt bridges with the people closest to them, which is why they are reaching out to someone they do not regularly talk to. Avoid bailing someone out of jail under these circumstances!

You Don’t Know Them Very Well

It is worse to bail a person out of jail if you don’t know them very well than it is if they call you out of the blue; however, both instances are big red flags. Never bail a person out of jail that you have just met or have only known for a little while. It takes years to truly know a person and trust their character, so if you don’t know much about a person, do not sign for their release from jail. This includes people you have only spoken to online, new co-workers, new boyfriends or girlfriends, friends of other friends, and of course, strangers.

You Don’t Understand the Terms of the Bail Bond Agreement

If you do not know what “co-signing” means, and the responsibility it entails in terms of a bail bond agreement, you should steer clear of bailing anyone from jail. A bail bond agreement is a serious contract that holds a co-signer legally liable for the cost of the defendant’s bond amount, which can be upwards of tens of thousands of dollars depending on their current criminal charges and past criminal record. A cosigner also takes on full legal liability in terms of making sure the defendant appears for all court hearings on time. This is a responsibility that should not be entered into lightly.

The Difference Between Bail and Bail Bond

Bail Bonds Indianapolis 317-876-9600

Bail Bonds Indianapolis 317-876-9600

Tomato tomahto, right? Well not in the surety industry. Often times, people confuse the terms bail and bail bond. Many people use the terms interchangeably, as if they mean the same thing, while others question how to use each term appropriately. If you are faced with the responsibility of bailing someone out of jail, you might want to be clear on these terms ahead of time. Continue reading to learn how bail is different from a bail bond.

What is Bail?

Bail refers to the amount of money set by a judge for a person to be released from jail to await their scheduled court hearings. The amount of money set by the courts is determined by the person’s past criminal record, current offense, and their level of threat to society. Their level of threat includes the likelihood of them committing another crime while awaiting sentencing.

Bail can be anywhere from a few hundred dollars to over five thousand dollars. Again, it all depends on the person’s record and the current charges their facing. Once the person pays the bail to the courts, and the money has “cleared” or been posted, the person can be let out of jail. If they complete all their court ordered requirements without any criminal indiscretions, they will receive the money back in full. If they fail to meet the court’s requirements, they lose rights to any monies paid, and will be arrested for court violation.

What is a Bail Bond?

A bail bond refers to a service or contract that facilitates a person’s release from jail by using a bail bondsman. The bail amounts set by courts can be very high and not everyone has that kind of cash available to them at once. In this case, a bail agency can be hired to secure a person’s release from jail. The agency guarantees the courts that you will appear for your scheduled hearing, and in return they allow the person to await their sentencing dates at home. The bail bondsman collects a non-refundable fee, usually between 10-15% depending on the state. If a person fails to appear for their hearing, the bail company will take professional and necessary means to search them down and bring them in to face the judge.
